These terms apply to all users, including patients, healthcare professionals, and visitors.
2. Eligibility
You must be at least 18 years of age to use Midcare. By using our platform, you represent and warrant that:
• You are at least 18 years old, or using the platform with parental/guardian consent
• You have the legal capacity to enter into a binding agreement
• All information you provide is accurate, current, and complete
3. Platform Description
Midcare is a technology platform that connects patients with verified healthcare professionals. We do not provide medical advice, diagnosis, or treatment directly. The medical services are provided by independent healthcare professionals registered on our platform.
Midcare acts as an intermediary and does not employ or endorse specific healthcare providers.
4. Account Registration
To access certain features, you must create an account. You agree to:
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized account access
• Accept responsibility for all activities that occur under your account
Midcare reserves the right to terminate accounts that violate these terms.
5. Appointments and Consultations
When booking an appointment through Midcare:
• You agree to attend scheduled appointments or cancel with sufficient notice (at least 2 hours prior)
• Repeated no-shows may result in account suspension
• Consultations are subject to the availability of healthcare professionals
• Emergency medical situations should be directed to emergency services (108/112)
6. Payments and Fees
• Consultation fees are clearly displayed before booking confirmation
• Payments are processed securely through our payment partners
• Refund eligibility is governed by our Refund Policy
• Midcare is not responsible for errors made by third-party payment processors
7. Prohibited Uses
You agree not to use Midcare for:
• Any unlawful or fraudulent purpose
• Harassing or threatening healthcare professionals or other users
• Sharing false or misleading health information
• Attempting to bypass security measures
• Scraping, crawling, or extracting platform data without permission
8. Intellectual Property
All content on the Midcare platform, including text, graphics, logos, and software, is the exclusive property of Midcare Health Pvt. Ltd. and protected by applicable intellectual property laws.
You may not reproduce, distribute, or create derivative works without our prior written consent.
9. Limitation of Liability
To the maximum extent permitted by law, Midcare shall not be liable for:
• Medical decisions or outcomes resulting from consultations booked through our platform
• Indirect, incidental, or consequential damages arising from use of our services
• Service interruptions or data loss beyond our reasonable control
10. Governing Law
These Terms and Conditions are governed by the laws of India. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka.
11. Changes to Terms
We reserve the right to modify these Terms at any time. Significant changes will be communicated via email or platform notification. Continued use of Midcare after changes constitutes acceptance of the revised terms.
